Sebagai bagian dari komitmen kami untuk melindungi data pribadi anda secara transparan, Bank telah menyiapkan pemberitahuan Pelindungan Data Pribadi (“Pemberitahuan Privasi”) ini untuk memberitahukan kepada anda, sebagai subjek data pribadi, tentang pelindungan data pribadi dan hak- hak anda sebagai hak subjek data pribadi yang merupakan:

1. Data pribadi yang dikumpulkan, dipergunakan dan diungkapkan
Data pribadi yang diperoleh, dikumpulkan, digunakan, dan diungkapkan oleh Bank adalah sebagai berikut:
1.1 Data yang dapat mengidentifikasi Anda sebagai subjek data pribadi, baik secara langsung maupun tidak langsung

Yaitu informasi mengenai data biometrik (seperti pengenalan wajah, pengenalan sidik jari, pengenalan iris mata dan data pengenalan suara), agama, catatan pelanggaran pidana dan kriminal, data kesehatan, data anak, disabilitas atau lainnya sebagaimana ditentukan oleh peraturan perundang-undangan Pelindungan Data Pribadi.
Bank hanya akan mengumpulkan data pribadi anak di bawah umur 18 (delapan belas) tahun apabila anak tersebut merupakan nasabah Bank, atau apabila Anda memberikan data pribadi anak Anda dan persetujuan pemrosesannya. Dalam setiap pemrosesan yang kami lakukan terkait dengan data pribadi anak, kami berasumsi bahwa wali dari anak tersebut telah melakukan hal yang seharusnya, termasuk membaca dan memahami Pemberitahuan Privasi ini.
2. Tujuan pengumpulan, penggunaan dan pengungkapan data pribadi Anda
Bank akan mengumpulkan, menggunakan dan mengungkapkan data pribadi Anda sesuai dengan dasar pemrosesan yang ditentukan oleh undang-undang, yaitu:

2.1 Mengkomunikasikan atau memberikan informasi terkait atau sehubungan dengan produk atau layanan Bank yang Anda gunakan atau akan gunakan;
2.2 Melaksanakan kewajiban Bank sebagaimana tercantum dalam permintaan/permohonan atau perjanjian yang Anda buat kepada Bank, atau sehubungan dengan permintaan/permohonan atau perjanjian tersebut, seperti pengiriman dan penerimaan dokumen dan penagihan utang, serta pemenuhan perjanjian yang dibuat antara Bank dan pihak lain yang diperlukan dan berkaitan dengan layanan yang diberikan kepada Anda;
2.3 Mengelola hubungan Anda dengan Bank, dan menyiapkan rincian atau catatan penggunaan layanan Anda untuk memberikan layanan lebih lanjut kepada Anda;
2.4 Mengelola informasi nasabah korporasi atau non-individu yang mungkin berisi data pribadi Anda;
2.5 Mematuhi ketentuan peraturan perundang-undangan dan peraturan terkait;
2.6 Melakukan verifikasi dan identifikasi identitas Anda sesuai dengan prosedur Prinsip Mengenal Nasabah Bank, termasuk memverifikasi informasi Anda dan mengaudit verifikasi tersebut sesuai dengan prosedur yang ditentukan oleh undang-undang dan Bank;
2.7 Mengambil tindakan apa pun sebagaimana diwajibkan atau direkomendasikan oleh otoritas pengawas, seperti tindakan untuk mencegah nasabah yang rentan dari pembatasan tertentu atau untuk mencegah nasabah lanjut usia melakukan jenis transaksi tertentu, dan tindakan untuk pengendalian kerusakan;
2.8 Mengelola dan mengadministrasikan operasional internal Bank, seperti mengawasi, meningkatkan dan mengaudit operasional internal Bank;
2.9 Mengelola atau menangani risiko, seperti:
2.10 Menyediakan dan menawarkan produk, layanan dan alternatifnya kepada Anda, yang meliputi kegiatan hubungan masyarakat, pengumuman, pemberitahuan, penawaran atau pemberian hak istimewa (privileges), manfaat, penghargaan (rewards) atau informasi yang berkaitan dengan produk atau layanan dari Bank, perusahaan afiliasi atau mitra bisnis Bank yang mungkin menarik minat Anda; atau untuk mengatur acara dan promosi, berpartisipasi dalam penarikan undian, atau memberikan hasil penarikan undian untuk Anda;
Bank akan meminta persetujuan Anda secara terpisah untuk kegiatan penawaran produk atau layanan tambahan atau baru sebagaimana dicantumkan di atas misalnya saat pembukaan rekening. Anda juga dapat sewaktu-waktu menarik persetujuan pemrosesan data pribadi Anda untuk tujuan kegiatan penawaran ini dengan menghubungi Kontak Bank seperti yang tertera di Pemberitahuan Privasi ini.
2.11 memeriksa penggunaan layanan atau transaksi/aktivitas yang dilakukan sesuai dengan instruksi anda atau pihak counter party anda;
2.12 memberikan layanan dan mengelola pengaduan, seperti memeriksa transaksi/aktivitas yang dihasilkan dari penggunaan produk atau layanan keuangan, transaksi keuangan yang dilakukan secara keliru, atau pengiriman data di internal Bank atau antara Bank dengan pihak lain, atau menampung pengaduan nasabah, memberikan kompensasi, atau menggunakan informasi untuk meningkatkan proses kerja mengenai hal-hal tersebut;
2.13 melakukan analisis atau penelitian statistik yang berkaitan dengan kegiatan usaha Bank dan perusahaan-perusahaan dalam kelompok usaha keuangan Bank atau afiliasi Bank;
2.14 melakukan penyesuaian terhadap strategi Bank, melindungi keuntungan atau mengevaluasi kinerja atau layanan Bank;
2.15 mengevaluasi, mengembangkan dan meningkatkan produk atau layanan Bank, atau melaksanakan hak-hak Bank (seperti membuat model penilaian kredit, penilaian perilaku, dan survei pasar), dan mengungkapkan informasi yang dihasilkan dari evaluasi tersebut kepada anda untuk perencanaan keuangan atau pemanfaatan lainnya jasa Bank atau kepada perusahaan-perusahaan dalam kelompok usaha keuangan atau mitra usaha Bank;
2.16 menyelenggarakan proyek atau kegiatan promosi, pertemuan, seminar, rekreasi dan kunjungan ke tempat kerja serta mencatat informasi atau foto untuk dipublikasikan atau diiklankan, serta melaksanakan dan mematuhi peraturan perundang-undangan yang berlaku;
2.17 menyimpan data dalam penyimpanan cloud dan sistem lain yang digunakan oleh Bank;
2.18 melaksanakan kewajiban Bank berdasarkan syarat dan ketentuan yang ditentukan dalam perjanjian dimana Bank menjadi salah satu pihak atau menjalankan hak hukum atau kontrak Bank;
2.19 menghubungkan atau memfasilitasi akses ke situs web, aplikasi-aplikasi dan platform-platform Bank atau orang lain;
2.20 melakukan pemeriksaan latar belakang pribadi sebagaimana diperlukan atau relevan dengan pertimbangan kualifikasi anda sebagaimana diwajibkan oleh undang-undang dan ditentukan oleh Bank;
2.21 bertindak sebagai wakil, melaksanakan kewajibannya, melaksanakan, atau melakukan tindakan apa pun sehubungan dengan kegiatan usaha Bank; atau
2.22 mengurus segala sesuatu yang berkaitan dengan pemegang efek atau kuasanya, kuasa hukum atau anggota dana pensiun/jaminan hari tua serta melaksanakan kewajibannya sebagai penerbit efek, atau pelaku usaha sehubungan dengan atau yang berkaitan dengan usaha efek, atau pihak dalam kontrak dengan penerbit efek, atau pelaku usaha yang berkaitan dengan atau sehubungan dengan usaha efek.
Pengumpulan, penggunaan atau pengungkapan data pribadi anda sebagaimana tersebut di atas juga termasuk pengiriman atau pemindahan data pribadi anda ke luar negeri yang telah dilakukan oleh Bank sesuai dengan prinsip-prinsip tersebut.
3. Orang atau badan kepada siapa Bank dapat mengungkapkan data pribadi anda
Bank mungkin diwajibkan untuk mengungkapkan data pribadi anda kepada orang atau entitas lain yang berlokasi di Indonesia atau di luar negeri untuk mencapai tujuan yang tercantum dalam Pemberitahuan Privasi ini, yaitu:
3.1 Pemegang saham pengendali Bank dan pihak terafiliasi dari Bank sebagaimana dipublikasikan dalam situs web Bank;
3.2 Mitra usaha Bank, seperti mitra usaha Bank yang berkaitan dengan bisnis keuangan, perbankan, penyedia jasa/layanan, investasi, pemasaran, transportasi, telekomunikasi, pusat kesehatan, asuransi kerugian, asuransi jiwa, asuransi kesehatan (non-jiwa); atau siapa pun yang terlibat dalam program promosi atau loyalitas atau analisis data apa pun; atau penyedia platform atau orang yang nama atau logonya tercantum dalam perjanjian dengan Bank, atau kartu elektronik, situs web atau saluran layanan Bank lainnya;
3.3 Pihak ketiga yang terlibat dalam penyediaan layanan Bank, misalnya pihak-pihak yang bertindak sebagai perantara dalam transaksi perbankan, penyedia layanan penyelesaian atau pembayaran, mitra layanan Bank, penyedia layanan alih daya, kontraktor pelaksana pekerjaan, penjual barang atau jasa kepada Bank, atau agen Bank baik di dalam negeri maupun di luar negeri, dengan siapa Bank mempunyai perjanjian atau kontrak, misalnya dengan penyedia jasa pengembangan infrastruktur, penyedia jasa internet, penyedia jasa telekomunikasi dan komunikasi, penyedia jasa infrastruktur teknis, penyedia jasa pengembangan sistem elektronik atau teknologi informasi, penyedia jasa logistik dan pergudangan, penyedia jasa cloud, dan penyedia jasa riset/penelitian, penyedia jasa analisis data, penyedia jasa komunikasi, penyedia jasa survei, penyelenggara acara dan kegiatan, penyedia jasa sistem verifikasi identitas, penyedia jasa Dip Chip, penyedia jasa verifikasi identitas, lembaga pemeringkat kredit, penyedia jasa kurir, produksi dan pencatatan data, penyedia jasa kartu elektronik, penyedia layanan yang menawarkan untuk menjual produk atau layanan keuangan Bank serta penyedia layanan keamanan dan pencegahan penipuan;
3.4 Orang atau pihak berwenang yang ditentukan oleh undang-undang. Bank mungkin diminta untuk mengungkapkan data pribadi anda untuk mematuhi undang-undang, aturan, peraturan atau perintah lembaga pemerintah, otoritas pengatur atau jika Bank yakin bahwa tindakan apa pun diperlukan untuk mematuhi undang-undang untuk melindungi hak-hak Bank. Bank atau orang lain, demi keselamatan setiap orang, untuk pencegahan dan penyidikan, atau penanggulangan penipuan, atau demi keamanan atau keselamatan dalam berbagai aspek;
3.5 Konsultan Bank, seperti penasihat keuangan, penasihat hukum, notaris, konsultan teknis dan auditor;
3.6 Penerima hak, kewajiban atau tagihan Bank, termasuk mereka yang terlibat dalam restrukturisasi perusahaan, pengalihan bisnis, investasi, merger dan akuisisi, pembelian atau penjualan aset, saham, atau bisnis, dalam hal ini orang-orang yang terlibat dalam tindakan tersebut juga akan mematuhi Pemberitahuan Privasi ini;
3.7 Orang-orang lain yang terkait dengan anda, misalnya, pemilik rekening simpanan atau deposito bersama, debitur bersama, wali amanat, penerima manfaat, pengurus harta warisan, orang yang berwenang, penjamin atau siapa pun yang menempatkan aset sebagai jaminan atas pembayaran utang anda kepada Bank, pengurus atau kurator;
3.8 Asosiasi, organisasi, perkumpulan dan lembaga, seperti Persatuan Bank Nasional, bank dan lembaga keuangan;
3.9 Situs-situs web dan media sosial, seperti, LinkedIn, Facebook, Google, atau Instagram.
4. Penyimpanan dan jangka waktu penyimpanan data pribadi anda
4.1 Penyimpanan data pribadi anda. Bank telah menetapkan langkah-langkah keamanan untuk melindungi data pribadi anda, baik dalam bentuk dokumen maupun elektronik, untuk mencegah kehilangan, akses, penggunaan, perubahan, koreksi atau pengungkapan data pribadi yang tidak sah atau melanggar hukum.
4.2 Periode penyimpanan data pribadi anda. Bank akan mengumpulkan data pribadi anda untuk tujuan yang diberitahukan kepada anda dalam Pemberitahuan Privasi ini sebagaimana diwajibkan oleh undang-undang dan untuk jangka waktu maksimal 10 (sepuluh) tahun sejak tanggal penghentian hubungan anda dengan Bank;
kecuali Bank dibenarkan lain oleh undang-undang atau semacamnya atau data pribadi terkait adalah data yang tidak dapat dihapus atau dimusnahkan karena keterbatasan teknis.
5. Pengiriman data pribadi anda ke luar negeri
Dalam hal Bank diharuskan mengirimkan atau memindahtangankan data pribadi anda kepada seseorang di luar negeri, seperti counter party anda atau counter party Bank, perwakilan Bank, cabang Bank di luar negeri, afiliasi Bank, atau lembaga atau organisasi internasional, maka perlu dicatat bahwa negara penerima mungkin memiliki standar yang tidak memadai untuk pelindungan data pribadi seperti yang disyaratkan oleh undang-undang. Bank akan tetap memberikan langkah-langkah yang tepat untuk memastikan bahwa data pribadi anda yang dikirimkan kepada penerima tersebut cukup aman.
6. Pengumpulan data melalui website dan/atau aplikasi-aplikasi Bank
Bank akan secara otomatis mengumpulkan informasi tertentu dari penggunaan anda terhadap situs web dan/atau aplikasi-aplikasi Bank untuk tujuan yang dinyatakan dalam Pemberitahuan Privasi ini, misalnya, informasi yang dicatat atau dikumpulkan oleh cookies dan teknologi serupa yang digunakan oleh Bank akan digunakan untuk analisis statistik, aktivitas lain dari situs web dan/atau aplikasi-aplikasi Bank, atau bisnis Bank sehingga memungkinkan Bank untuk meningkatkan pengalaman anda dalam menjelajahi situs web dan/atau aplikasi-aplikasi Bank, serta meningkatkan efisiensi dan kualitas layanan situs web dan/atau aplikasi-aplikasi Bank.
7. Hak-hak subjek data pribadi
Dengan memperhatikan pengecualian yang diatur dalam peraturan perundang-undangan yang berlaku, hak-hak anda sebagai subjek data pribadi adalah sebagai berikut:
7.1 Hak untuk meminta akses dan memperoleh salinan data pribadi
Anda mempunyai hak untuk meminta akses dan mendapatkan salinan data pribadi anda yang menjadi tanggung jawab Bank sesuai dengan ketentuan peraturan perundang-undangan dalam bentuk yang sesuai dengan struktur dan/atau format yang lazim digunakan atau dapat dibaca oleh sistem elektronik.
7.2 Hak untuk memperoleh atau mengirim atau mentransfer data pribadi ke pengontrol data lain
Anda mempunyai hak untuk mendapatkan data pribadi anda yang diberikan kepada Bank dengan persetujuan anda, atau dikumpulkan oleh Bank sebagaimana diperlukan untuk pelaksanaan berdasarkan perjanjian atau permohon.an yang dibuat kepada Bank atau sebagaimana ditentukan oleh peraturan perundang-undangan Pelindungan Data Pribadi terkait, di mana Bank telah membuat data pribadi tersebut dalam bentuk yang dapat dibaca atau digunakan secara umum melalui alat atau perangkat otomatis dan data pribadi tersebut dapat digunakan atau diungkapkan dengan cara otomatis. Selain itu, anda juga berhak untuk (1) meminta Bank untuk mengirimkan atau mentransfer data pribadi dalam bentuk tersebut kepada pengontrol data lain bila dapat diproses melalui cara otomatis dan (2) meminta untuk mendapatkan data pribadi yang dikirim atau ditransfer oleh Bank dalam bentuk tersebut di atas kepada pengontrol data lain kecuali secara teknis tidak dapat dilaksanakan.
7.3 Hak untuk menolak
Anda mempunyai hak untuk menolak pengumpulan, penggunaan atau pengungkapan data pribadi anda oleh Bank dalam hal:
kecuali jika diperlukan untuk melaksanakan tugas Bank demi kepentingan umum.
7.4 Hak untuk menghapus atau memusnahkan data pribadi
Anda berhak meminta Bank untuk menghapus, menghancurkan, atau menganonimkan data pribadi anda jika:

Anda berhak untuk menangguhkan penggunaan data pribadi anda dalam hal:
7.6 Hak untuk memperbaiki data pribadi
Anda berhak meminta Bank untuk memperbaiki data pribadi anda agar akurat, terkini, lengkap dan tidak menyesatkan.
7.7 Hak untuk menarik persetujuan
Anda mempunyai hak untuk menarik persetujuan yang anda berikan kepada Bank untuk pengumpulan, penggunaan dan pengungkapan data pribadi anda kapan saja.
7.8 Hak untuk menyampaikan pemberitahuan pencabutan persetujuan
Anda berhak untuk mencabut persetujuan atas pengumpulan data pribadi yang telah dikumpulkan oleh Bank sebelum Undang-Undang Nomor 27 Tahun 2022 tentang Pelindungan Data Pribadi mulai berlaku dengan menyampaikan pemberitahuan pencabutan persetujuan kepada kantor cabang atau unit kerja utama Bank tempat Anda memanfaatkan atau pernah memanfaatkan layanan Bank.
7.9 Hak untuk mengajukan pengaduan
Anda berhak mengajukan pengaduan kepada instansi yang berwenang atau badan mana pun yang mempunyai kewenangan hukum apabila Bank atau pengolah datanya, termasuk karyawan atau kontraktor Bank melanggar atau tidak mematuhi undang-undang tentang pelindungan data pribadi.
Jika anda ingin menggunakan hak apa pun berdasarkan Klausul 7.1 hingga 7.7 yang ditetapkan di atas, anda dapat mengajukan permintaan kepada Bank melalui cabang Bank mana pun atau melalui saluran lain yang ditentukan oleh Bank. Setelah Bank menerima permintaan anda, Bank akan mempertimbangkan permintaan anda sesuai dengan peraturan dan ketentuan yang ditentukan oleh undang-undang, memenuhi permintaan anda, dan memberi tahu anda hasil pertimbangan dan tindakan yang diambil dalam waktu 30 (tiga puluh) hari kalender sejak tanggal penerimaan permohonan dan seluruh dokumen pendukungnya.
Jika anda menggunakan hak subjek data pribadi, anda mungkin tidak dapat menggunakan layanan tertentu dari Bank ketika Bank sedang dalam proses mempertimbangkan atau memenuhi permintaan anda.
Bank tidak akan mengenakan biaya atas pelaksanaan hak tersebut, kecuali Bank menganggap permintaan anda berlebihan atau tidak masuk akal. Bank dapat mengenakan biaya untuk memenuhi permintaan anda sesuai tarif yang diumumkan oleh Bank.
Dengan ketentuan anda dapat meminta untuk menggunakan hak anda terhitung sejak tanggal berlakunya Undang-Undang Nomor 27 Tahun 2022 tentang Pelindungan Data Pribadi.
8. Perubahan pada Pemberitahuan Privasi ini
Bank dapat mengubah Pemberitahuan Privasi ini dari waktu ke waktu jika dianggap perlu dan Bank akan memberitahukan anda tentang perubahan tersebut melalui cabang-cabang Bank, situs web, dan aplikasi-aplikasi Bank. Bank menyarankan agar anda membaca dan memeriksa rincian Pemberitahuan Privasi setiap kali perubahan tersebut dilakukan.
9. Informasi Kontak
Jika anda ingin menghubungi atau ingin menerima informasi atau penjelasan lebih lanjut mengenai pengumpulan, penggunaan dan pengungkapan data pribadi anda, serta pelaksanaan hak subjek data pribadi yang ditentukan dalam Pemberitahuan Privasi ini, silakan menghubungi cabang atau unit utama Bank tempat anda menggunakan atau biasa memanfaatkan layanan Bank tersebut.
